The Trump administration is working on a bill that will make healthcare and protection largely impossible for transgender people. It is the umpteenth anti-transgender and anti-gay bill that is introduced under the presidency of Donald Trump.
If the bill passes, care providers, insurance companies and hospitals, among others, will be allowed to discriminate against transgender people. The Trump administration must first adapt or cancel the Affordable Care Act, a health care reform introduced by former President Obama. This act prohibits discrimination based on gender.
The way in which the term ‘gender’ is defined, however, has always been a permanent point of contention in the US. Under the Obama administration, the definition of ‘gender’ was interpreted as gender identity, providing protection for transgender patients.
However, the Trump White House is of the opinion that this definition goes too far. In 2016, a Texas judge issued a temporary injunction prohibiting the provision of the Affordable Care Act, a consequence of several religious groups filing a lawsuit against the act, claiming that it violated their religious beliefs. The White House has indicated that they support this decision.
Earlier this month, the law came into effect that excludes some transgender people in the army. Last year, there was a memo that stated that transgender people are only allowed to use the public toilets that are associated with their birth gender. This memo also applies to schools and prisons. In addition to this, numerous anti-LGB laws have already been introduced under President Trump, focusing primarily on so-called religious freedom, with the result that LGBT people and transgender people can be discriminated against legally.
