PvdA in Favour of Constitutional Ban on LHBT Discrimination

The Dutch Labour party PvdA now also wants an explicit ban on LGBT discrimination in the Constitution. Last August, the PvdA spokeswomen for emancipation announced that her party is embracing the plea for this ban by the Dutch gay interest group COC. The party also wants to include a ban on transgender discrimination in the Equal Treatment Act.

Keklik Yücel: “We have come a long way in The Netherlands when it comes to the rights of LGBTs. But it was hard-fought, and this battle deserves full recognition of equal rights. How can you be clearer than specifying in article 1 of our Constitution that discrimination of LGBTs will not be accepted.”

According to the PvdA, a constitutional revision takes time, but will be revived quickly by a previously submitted private member's bill with similar meaning, which will be reviewed on legal pitfalls and possibilities.

Transgender discrimination

Keklik Yücel also calls on Minister of the Interior Plasterk to anchor the position of transgenders in the Equal Treatment Act (AWGB). She thinks it is high time to include an explicit ban on discrimination on the basis of gender identity and expression in the AWGB. In this act, the rights of homosexuals are already anchored.

Keklik Yücel: “When it comes to the labour market, transgenders need special attention, as research shows that transgenders are unemployed or unable to work four times as much as the general public. The PvdA is of the opinion that this constitutional revision is necessary for stricter legal protection of transgenders on the labour market.”

The Netherlands Institute for Human Rights has indicated in the past that such a revision is advisable to achieve awareness, for both transgenders and for society as a whole.

COC Netherlands and TNN have been advocating a ban on transgender discrimination in the Equal Treatment Act for several years. The COC would like to introduce such a ban as an issue for the new Pink Ballot Agreement with the government and parliament, following the Pink Ballot Agreement of 2012.

Keklik Yücel: “The LGBTs fight for acceptance is one for the long haul. People have to fight for acceptance each day, also in our country. Too often, they are physically or verbally assaulted. Just for who they are. The PvdA will continue to support this fight. Making complete the rights of LGBTs brings us one step closer to a society in which everyone can be themselves, and can make the best of their lives.”
